    State Propositions

    Proposition 98 Government Acquisition, Regulation of Private Property
    Bars state and local governments from condemning or damaging private property for private uses. Prohibits rent control and similar measures. Prohibits deference to government in property rights cases. Defines "just compensation." Requires an award of attorneys fees and costs if a property owner obtains a judgment for more than the amount offered by the government. Requires government to offer to original owner of condemned property the right to repurchase property at condemned price when property is put to substantially different use than was publicly stated. Summary of estimate by Legislative Analyst and Director of Finance of fiscal impact on state and local government: Increased costs to many governments due to the measure's restrictions. The fiscal effect on most governments probably would not be significant.

    Proposition 99 Eminent Domain. Acquisition of Owner-Occupied Residence
    Bars state and local governments from using eminent domain to acquire an owner-occupied residence, as defined, for conveyance to a private person or business entity. Creates exceptions for public work or improvement, public health and safety protection, and crime prevention. Summary of estimate by Legislative Analyst and Director of Finance of fiscal impact on state and local government: The measure would likely not have a significant fiscal impact on state or local governments.

    Local Propositions

    Proposition A Exemption Of Core Public Safety Services From Managed Competition -- City of San Diego (Charter Amendment - Majority Approval Required)
    Shall the voters approve an amendment to the Charter to exempt from the Managed Competition process the core public safety services provided by police officers, firefighters, and lifeguards who participate in the City's Safety Retirement System?

    Proposition B Permanency Of The Strong Mayor Form Of Goverance -- City of San Diego (Charter Amendment - Majority Approval Required)
    Shall the voters approve an amendment to the Charter to require the City Council to submit to voters at the June 2010 election Charter amendments making the Strong Mayor form of government permanent; adding a Council seat; and, when the ninth seat is filled, increasing the Council votes required to override a mayoral veto?

    Proposition C Financial Officers and Responsibilities -- City of San Diego (Charter Amendment - Majority Approval Required)
    Shall the voters approve amendments to the Charter to establish or modify the offices and responsibilities of a Chief Financial Officer, City Auditor, and Independent Budget Analyst; modify the City Treasurer appointment process; and create an Audit Committee to oversee the City Auditor?

    Proposition D Proposed Charter For Municipal Affairs -- City of Carlsbad (City Charter - Majority Approval Required)
    Shall the Proposed City Charter of the City of Carlsbad be Adopted?

    Proposition E Require Voter Approval for Allowable Building Heights -- City of Chula Vista (General Plan Amendment - Majority Approval Required)
    Shall the ordinance amending Chula Vista's General Plan to require voter approval for General Plan changes increasing allowable building heights above 84 feet in most areas of the City, and setting a building height limit of 45 feet in a designated area on Third Avenue be adopted?

    Proposition F Transient Occupancy Tax For Short Term Rental Units -- City of Encinitas (City Ordinance - Majority Approval Required)
    Shall an ordinance be approved to amend Section 3.12.030 of the Encinitas Municipal Code to require guests of short term rental units (for 30 days or less) to pay 8% of the rent charged as a transient occupancy tax effective January 1, 2009?

    Proposition G Transient Occupancy Tax For Short Term Rental Units -- City of Encinitas (City Ordinance - Two-Thirds Approval Required)
    Shall an ordinance be approved to amend Section 3.12.030 of the Encinitas Municipal Code to require guests of short term rental units (30 days or less) to pay 2% of the rent charged as a special transient occupancy tax for beach sand replenishment and stabilization projects effective January 1, 2009?

    Proposition H School Modernization, Safety and Technology Measure -- Oceanside Unified School District (General Obligation Bond - 55% Approval Required)
    To improve learning, assure local students access to comparable, modern classrooms, facilities and technology, shall Oceanside Unified School District issue $195 million in bonds to replace deteriorated plumbing/sewer/roofing systems; renovate student restrooms; improve school/playground safety/security; upgrade or replace outdated electrical, heating/ventilation systems, and aging portable classrooms; at legal interest rates, with mandatory audits, independent citizens' oversight, no money for administrators' salaries and NO estimated tax rate increase?
