Section 8.01: The Law Director of the City of North College Hill shall henceforth be appointed by the Mayor and approved by a majority of City Council. The Mayor and a majority of City Council must also jointly approve the removal of the Law Director. This amendment shall take effect upon the completion of the currently elected Law Director's term of office or upon his resignation, whichever occurs first. Section 8.02: The Law Director shall be an attorney-at-law admitted to practice in Ohio. She or he need not be a qualified resident elector of the City of North College Hill.

Shall Article XIII: Nominations and Elections, Sections 13.04, 13.05, 13.06, 13.07 and 13.08 be amended as follows?

Section 13.04: All candidates for elective municipal offices in the City of North College Hill shall henceforth appear on the ballot without political party affiliation. This restriction puts no additional limitations on the manner in which candidates are permitted to run their campaigns. In other words, candidates may advertise their party affiliation on signs, literature, and all other forms of media.

Section 13.05: A Municipal candidate elected in North College Hill but who is unable to complete one's term of office for any reason shall be replaced by members of the election committee designated by the successful candidate on her/his petition for election that was filed with the County Board of Elections prior to the General Election.

Section 13.06: The replacement's term of office shall extend only to the next general election if the original successful candidate was unable to serve at least one full year. At that time, an election will be held to select a candidate to fill out the unexpired term of office.

Section 13.07: If the original successful candidate was able to serve for one year or more, the replacement shall serve out the entire unexpired term.

Section 13.08: If, for any reason, a successful candidate who is unable to serve out one's term of office failed to designate an election committee on the petition for election submitted to the County Board of Elections prior to the General Elections, she or he shall be replaced by the majority of Council sitting at the time of the office holders' vacancy.

Shall Article II. THE COUNCIL, Section 2.02 QUALIFICATIONS of the Charter of Lincoln Heights be amended as follows:

Any qualified resident elector who has been a resident of the Municipality for a continuous period of time not less than one year preceding the election shall be eligible to serve as a member of Council. An Elector who is delinquent on taxes due the Village or who has been convicted of a felony, treason, or who has been imprisoned for a felony shall not be qualified to serve as a member of Council. In addition, an Elector who has been recalled by the voters of Lincoln Heights pursuant to Section 6.01 of the Charter shall not be qualified to serve as a member of Council until a period of five calendar years has passed since the date of the election by which the Elector was recalled. Council members shall not hold any other public office or any other employment with the Municipality of Lincoln Heights except that of a Notary Public, or a member of the National Guard or a Reserve in the Armed Forces. All members of Council must be willing to accept and receive on going training in laws or other regulations pertaining to Local, County, State, National or Federal affairs.

A member shall remain a qualified domicile resident elector of the Municipality during a member's term of office. A member who ceases to be a qualified domicile resident elector shall automatically have his or her seat declared vacant.
