Shall the City of San Leandro Charter be amended to provide that the City Council, at its first regular meeting in January of each year, shall designate one of its members Vice Mayor, to serve for a period of one year and until a successor is elected and qualified?

The San Leandro City Council has placed a measure on the November 4, 2014 ballot asking voters to approve an amendment to the City's Charter to change which regular meeting of a particular month during a calendar year that the City Council may designate one of its members as the Vice Mayor.

The City Council changed the date of its General Municipal Election from April of even numbered years. The City Council passed an ordinance in 2010 to consolidate its General Municipal Election with the California General Election to be conducted on the first Tuesday after the first Monday in November of even numbered years.

Currently, City Charter section 310 provides that at the first regular meeting in May of each y ear, the City Council shall designate one of its members Vice Mayor, to serve for a period of one year and until a successor is elected and qualified.

The City Council submits to the voters an amendment to City Charter section 310 to provide that the City Council shall designate one of its members Vice Mayor at the first regular meeting in January of each year , to serve for a period of one year and until a successor is elected and qualified. Therefore, instead of designating a Vice Mayor at the first regular meeting in May of each year, the Council would designate a Vice Mayor at the first regular meeting in January of each year.

To amend the City Charter, this measure must receive a majority "yes" vote. A "no" vote will not amend the City Charter, and the regular meeting at which the City Council currently designate s a Vice Mayor would remain the first regular meeting in May of each year, and that member would serve for a period of one year and until a successor is elected and qualified.

Arguments For Measure II Arguments Against Measure II
Measure II is a technical amendment to the San Leandro City Charter to align the selection of the Vice Mayor by the City Council to when new Council members take office. Amendments to the City Charter can only be made by a vote of the people.

Under our City Charter, the Vice Mayor shall possess and perform the powers and duties of the Mayor in the absence of the Mayor.

Most cities make their Vice Mayor selections in the month after their elections are held. Until 1994, San Leandro held its General Municipal Election in April of even-numbered years, and made the Vice Mayor selection in May.

We now conduct our municipal elections in November and on the same ballot as the California General Election. This move has doubled voter turnout and saved our City tens of thousands of dollars.

In 2004, San Leandro voters amended the City Charter to provide that the members of the City Council elected in November shall take office on January 1. However, the City Charter still specifies that the Vice Mayor selection be made in May.

The Vice Mayor selection should be made in January, when the new Council is seated. This is why the City Council voted to place Measure II on the ballot. Measure II will make this change, and only this change, in the City Charter.

CITY OF SAN LEANDRO PROPOSED AMENDMENT TO CITY CHARTER ARTICLE III. CITY COUNCIL: FUNCTIONS

Section 1. Section 310 of the City Charter is hereby amended to read as follows:

Section 310: VICE MAYOR. At its first regular meeting in May January of each year, the City Council shall designate one of its members Vice Mayor, to serve for a period of one year and until a successor is elected and qualified. In the absence of the Mayor, the Vice Mayor shall possess and perform the powers and duties of the Mayor.
