Shall the ordinance implementing term limits for the City Council, City Treasurer, and City Clerk be adopted?

Impartial Analysis
In the city of Monterey Park, voters may elect a person to serve on the city council; serve as the city treasurer; or serve as the city clerk (collectively referred to in this Impartial Analysis as a "public official"). California law provides that a person may serve as a public official for a term of four years; there is no limit on how many times a person may serve as a public official.

Measure EE proposes to impose term limits upon persons who serve on the Monterey Park city council; as the city clerk; and as the city treasurer.

If adopted by voters, Measure EE would limit the time of service for any particular public official to two consecutive terms. After serving two consecutive terms, a person would need to wait two years before again being eligible to serve in the same public office.

A person would, however, be eligible to serve as a different public official without having to wait two years. For example, a person could serve a total of eight years as a councilmember; serve as the city clerk for four years; and then serve another eight years as a councilmember.

Pursuant to Measure EE, persons who are elected or appointed to serve a partial term as a public official for more than two years are deemed to have served a full four-year term. If a public official resigns before the end of their term, Measure EE deems such public official to have served a full four-year term.

If adopted, Measure EE would apply to persons who are elected to be public officials on the same ballot as Measure EE. It would not, however, apply to current public officials.

California law is unclear whether voters may impose term limits on the offices of city treasurer and city clerk. The law is clear, however, that voters may impose term limits on the city council.

Any successful legal challenge overturning term limits on the city treasurer and city clerk would not affect term limits imposed on the city council.

To be adopted, Measure EE must be approved by a simple majority of the voters in the city of Monterey Park.

A "yes" vote on Measure EE favors the Measure.

A "no" vote on Measure EE opposes the Measure.
