The Sixth Amendment to the US Constitution grants the right to a speedy trial, as does the PA Constitution. The Commonwealth has the burden to bring a defendant to trial in 365 days and effectively to comply with the Constitutions. Courts must use modern technology and work with all sides to insure timely trials. Budgetary cutbacks cannot be used as an excuse or shield for the judiciary not hearing cases on time. |
