    State Propositions

Proposition 98 Government Acquisition, Regulation of Private Property
Bars state and local governments from condemning or damaging private property for private uses. Prohibits rent control and similar measures. Prohibits deference to government in property rights cases. Defines "just compensation." Requires an award of attorneys fees and costs if a property owner obtains a judgment for more than the amount offered by the government. Requires government to offer to original owner of condemned property the right to repurchase property at condemned price when property is put to substantially different use than was publicly stated. Summary of estimate by Legislative Analyst and Director of Finance of fiscal impact on state and local government: Increased costs to many governments due to the measure's restrictions. The fiscal effect on most governments probably would not be significant.

Proposition 99 Eminent Domain. Acquisition of Owner-Occupied Residence
Bars state and local governments from using eminent domain to acquire an owner-occupied residence, as defined, for conveyance to a private person or business entity. Creates exceptions for public work or improvement, public health and safety protection, and crime prevention. Summary of estimate by Legislative Analyst and Director of Finance of fiscal impact on state and local government: The measure would likely not have a significant fiscal impact on state or local governments.

    Local Measures

Measure G Bond Authorization -- Santa Ana Unified School District (2/3 Approval Required)
Authorize the school district to issue and sell bonds of up to $200,000,000 in principal at interest rates below the legal limit, to provide financing for the school facilities projects stated in the Measure.

Measure H City Council Ethical Public Service Ordinance -- City of Irvine (Ordinance)
This ballot measure would enact voter-adopted restrictions on certain conduct of the Mayor and the members of the City Council and of their Executive Assistants and appointed Commissioners. More specifically, the measure would prohibit the Mayor and the members of the City Council and their Executive Assistants and appointed Commissioners from engaging in compensated employment or service for lobbying for any private person or organization before any local public agency located in the County of Orange.

Measure I Shorecliffs Building Height and View Referendum -- City of San Clemente (Ordinance)
An ordinance of the people of the City of San Clemente, California amending Appendix "A" of Title 17 of the San Clemente municipal code, zoning, for purposes of adding special residential development standards to the Shorecliffs Rl-11 and Rl-12 overlay zones regulating residential development within the overlay areas for the purposes of neighborhood preservation and view; and amending Section 17.16.090 of Title 17 of the municipal code, zoning, for purposes of a minor exception permit process to allow a reduction of the required minimum rear yard; and amending Section 17.16.060 of Title 17 of the municipal code, zoning, for purposes of a conditional use permit process to allow an increase of the allowed maximum height.
