"Large Retail Developments" (hereinafter "LDR") are defined as any development that includes a planned integrated commercial development comprising more than 200,000 square feet of gross leasable area for retail, restaurant, entertainment, and movie theater purposes.

Establishments not fitting within the definition of LDRs would not be prohibited from charging a fee for off-street self parking or imposing time limits.

The passage of Measure P would mean that LDRs may not restrict parking only to patrons or employees, but must provide parking free to anyone (except for valet parking described above). Measure P could have the following effects, among others: (1) LDRs would lose potential parking revenue, thereby potentially affecting the return on their investments; (2) tenants in LDRs may have to pay higher lease rates; (3) developers might be discouraged from developing LDRs or operating them within the City; (4) the City may be prevented from raising revenue through potential imposition of taxes on parking in LDRs; and (5) free parking on property adjacent to uses that charge for parking (such as the Santa Anita Race Track) may encourage persons to park at nearby LDRs which cannot charge for parking, thereby depriving uses (such as the Race Track), located near potential LDRs, of parking revenue and depriving LDRs of parking spaces potentially needed to serve their business tenants. In addition, Measure P might encourage patrons to patronize LDRs, instead of patronizing other establishments, due to free parking.

A legal question exists regarding whether Measure P constitutes a regulatory taking of property (i.e. ability to charge for parking) for which the City of Arcadia would potentially be required to pay compensation, or constitutes denial of due process in not providing a property owner a legal mechanism to determine and allow a fair return on investment in property.

No fiscal analysis of Measure P has been performed by the City.

If approved, Measure P may not be changed except upon subsequent approval by the voters.

A "yes" vote is a vote in favor of amending the Arcadia Zoning Code to require Large Retail Developments to provide, for the most part, free off-street self parking.

A "no" vote is a vote not to amend the Arcadia Zoning Code to require Large Retail Developments to provide, for the most part, free off-street self parking.
