Shall Ordinance No. 2006-5, which would prohibit the parking of trailers and semi-trailers on streets in the City, except while in the process of being loaded or unloaded or by City permit, be approved? ¿Debe aprobarse la ordenanza No. 2006-5, que prohíbe el estacionamiento de remolques (trailers) y semi-remolques en las calles de la ciudad, excepto cuando este en el proceso de ser cargado o descargado o con permiso municipal?

At present, in the City of Lakewood it is legal to park trailers and semi-trailers on streets. Such vehicles are subject to the same parking restrictions as any other vehicle, such as the prohibition against parking for more than 72 hours. If adopted by a majority of the voters, the proposed Ordinance would make it illegal to park a trailer or semi-trailer, whether detached or attached to a motorized vehicle, on any street, except with a parking permit obtained from the City. The Ordinance provides that the City Council retains the legal ability to determine the parameters for the issuance of such permits.

The proposed Ordinance would not have any legal effect whatsoever on the parking of trailers or semi-trailers on private property.

§ A "Yes" vote on the proposed Ordinance is a vote to prohibit the parking of trailers and semi-trailers on residential streets except with a parking permit obtained from the City or while it's being loaded or unloaded.

§ A "No" vote is to leave the law unchanged, so that trailers and semi-trailers are subject only to the general parking restrictions.

En la Ciudad de Lakewood es actualmente legal estacionar remolques y semirremolques en las calles y callejones de zonas residenciales. Dichos vehículos están sujetos a las mismas restricciones de estacionamiento que otros vehículo, como la prohibición de estacionamiento por más de 72 horas. Si la adoptara una mayoría de los votantes, la ordenanza propuesta haría ilegal estacionar un remolque o semirremolque, estuviese éste acoplado o no acoplado a un vehículo motorizado, en cualquier calle o callejón de una zona residencial excepto mediante permiso de estacionamiento obtenido de la ciudad. La ordenanza dispone que el concejo municipal conserve la capacidad legal de determinar los parámetros para la emisión de dichos permisos.

La ordenanza propuesta no tendría ningún afecto legal en el estacionamiento de remolques y semirremolques en propiedad privada.

§ Un voto de “Sí” con respecto a la ordenanza propuesta es un voto para prohibir el estacionamiento de remolques y semirremolques en calles residenciales excepto con un permiso de la ciudad.

§ Un voto de “No” es para dejar la ley sin cambiar, permitiendo que los remolques y semirremolques sean sujetos únicamente a las restricciones generales de estacionamiento.

ORDINANCE NO. 2006-5

AN ORDINANCE OF THE CITY OF LAKEWOOD, CALIFORNIA,
PROHIBITING THE PARKING OF TRAILERS AND SEMI-TRAILERS ON STREETS IN THE CITY, EXCEPT BY CITY PERMIT

THE PEOPLE OF THE CITY OF LAKEWOOD, DO ORDAIN AS FOLLOWS:

SECTION 1. Subsection L of Section 3251 of the Lakewood Municipal Code is hereby amended to read as follows:

"R. A person shall not park any trailer or semi-trailer, whether or not attached to a motorized vehicle, upon any highway, street, alley, public way or public place in the City, except with a City permit. Such parking restriction shall not apply to trailers or semi-trailers which are in the process of being loaded or unloaded, nor to any trailer or semi-trailer which is disabled in such a manner and to such an extent that it is impossible to avoid stopping and temporarily parking such trailer or semi-trailer. Each daily violation of this Subsection shall constitute a separate infraction, punishable by a fine as set by City Council Resolution. Vehicles falling within the definition of "trailer or semi-trailer" include, but are not limited to, the following:

1. Camp trailers (CA Vehicle Code Section 242).
2. Fifth-wheel travel trailers (VC Section 324).
3. House cars (VC Section 362).
4. Trailer coaches (VC Section 635).
5. Boats and/or boat trailers.
6. Trailers used for the transport of equipment, vehicles or animals.
7. Those non-motorized vehicles included in the definition of "Recreational vehicles" (CA Health & Safety Code Section 18010).
8. Folding camping trailers."

SECTION 2. Subsection M of Section 3251 of the Lakewood Municipal Code is hereby repealed.

SECTION 3. The adoption of this Ordinance shall not affect any permit system for the legal parking of such trailers and semi-trailers, adopted and implemented by the City Council, whether before or after the adoption of this Ordinance.

SECTION 4. This Ordinance shall be effective if approved by a majority vote of the electorate voting on the issue, at the Special Election to be held on November 7, 2006, within the City of Lakewood. If so approved, the City Clerk shall certify to adoption of this Ordinance, which shall take effect on July 1, 2007.
