Shall Ordinance No. 2006-4, which would impose a ban on the sale, offer for sale, possession, use or discharge of fireworks, be approved? ¿Debería ser aprobada la ordenanza No. 2006-4, que impondría una prohibición sobre la venta, oferta de venta, posesión, uso o descargo de fuegos artificiales?

At present, in the City of Lakewood it is legal to sell, possess or use “safe and sane” fireworks, as defined in State law, at certain times leading up to and including the 4th of July holiday. The sale, possession or use of such “safe and sane” fireworks at other times, and the sale, possession or use of all other types of fireworks at any time, are illegal per State and local law. If adopted by a majority of the voters, the proposed Ordinance would make it illegal for any person to sell, possess or use any type of fireworks, at any time, in the City of Lakewood.

A “Yes” vote on the proposed Ordinance is a vote to impose a complete fireworks ban.

A “No” vote is a vote to leave the law unchanged, so that “safe and sane” fireworks remain legal within the present time limitations.

En la Ciudad de Lakewood es actualmente legal vender, poseer o usar fuegos artificiales definidos ser “safe and sane” por la ley estatal a ciertas horas hasta e incluyendo el día festivo 4 de julio. La venta, posesión o uso de dichos fuegos artificiales “safe and sane” a otras horas y la venta, posesión, y uso de todo otro tipo de fuegos artificiales en cualquier momento es ilegal según las leyes locales y estatales. ORDINANCE NO. 2006-4

AN ORDINANCE OF THE CITY OF LAKEWOOD
IMPOSING A BAN ON THE SALE, OFFER FOR SALE, POSSESSION, USE OR DISCHARGE OF FIREWORKS.

THE PEOPLE OF THE CITY OF LAKEWOOD DO ORDAIN AS FOLLOWS:

SECTION 1. Section 3105 of the Lakewood Municipal Code is hereby amended to read as follows:

"It shall be unlawful for any person to sell, offer for sale, possess, use or discharge fireworks of any kind, at any time in the City, except as set forth in Section 3106."

SECTION 2. Sections 3105.1, 3105.2, 3105.3, 3105.4, 3105.5 and 3105.6 of the Lakewood Municipal Code are hereby repealed.

SECTION 3. This Ordinance shall be effective if approved by a majority vote of the electorate voting on the issue, at the Special Election to be held on November 7, 2006, within the City of Lakewood. If so approved, the City Clerk shall certify to adoption of this Ordinance, which shall take effect immediately upon such certification.
