Shall the office of City Treasurer be appointive?

The office of City Treasurer is one of the offices that make up the government of general law cities in California. City treasurers are responsible for performing the duties set forth in Government Code Section 41001 et seq., including but not limited to receiving and safely keeping monies submitted to the Treasurer, handling public and trust funds in his or her possession, paying out of City money, and performing the duties related to the collection of City taxes and license fees as prescribed by ordinance.

City treasurers may be either elected or appointed. By state law, elected city treasurers must reside and be a registered voter in the city in which they hold office. This requirement does not apply to appointed city treasurers. State law authorizes city elections on whether to make an elective city office (except for the office of city council member) appointive. Currently, the office of City Treasurer in the City of Pinole is an elective office and is subject to state statutes governing qualification for office, including residency and voter registration requirements, and terms of office.

Effect if the Measure Passes

If a majority of those voting vote "yes" on this measure, then the office of City Treasurer in the City of Pinole will become an appointive office effective December 5, 2006, or earlier if a vacancy occurs before December 5, 2006. If this measure passes, the Pinole City Treasurer will no longer be legally required to be a resident and registered voter in the City. Also, the City Treasurer will hold office at the pleasure of the City Council and be subject to City terms of employment and personnel procedures, including those governing performance appraisals and termination. In addition, the City Council may by ordinance delegate authority to appoint the City Treasurer to the City Manager.

Effect if the Measure Does Not Pass

If this measure does not pass, the office of City Treasurer in Pinole will continue to be an elective office subject to state law terms of office and residency and voter registration requirements.
