Shall the San Diego County Charter amended be to allow "write-in" candidates to participate in primary elections, but not in general elections, for County Supervisor and for other County elected offices?

Impartial Analysis from County Counsel
This measure proposes "write-in" candidate amendments to the San Diego County Charter. These "write-in" candidate amendments would be applicable to County elections. Charter amendments must be approved by a majority of the County voters voting on the measure.

County Office Elections Affected by Proposed "Write-In" Candidate Amendments
This measure would amend Charter sections 401.3, 401.4, 500.2, and 603.l. These proposed amendments apply to the eligibility of "write-in" candidates to participate in County primary and general elections for the office of County Supervisor, County elected officers (the Assessor/Recorder/County Clerk, District Attorney, Sheriff, and Treasurer-Tax Collector), and Members of the County Board of Education.

Summary of Proposed "Write-In" Candidate Amendments to the County Charter
The proposed amendments, if approved by the voters, would provide that "write-in" candidates are eligible to participate in primary elections, but would not be eligible to participate in general elections. Any candidate in the primary election, including a "write-in" candidate, who receives a majority of all votes cast in the primary election would be elected. If no candidate in the primary election receives a majority of votes, the two candidates (including "write-in" candidates, if any) who receive the highest number of votes will be the only candidates in the runoff general election. This measure makes clear that no person would be eligible to participate in the general election as a "write-in" candidate.

Affect of Proposed "Write-In" Candidate Amendments on County Elections
This measure would require all candidates (whether on the ballot or by "write-in") for a County office to participate in the primary election in order to be eligible to run in the general election. If no candidate in the primary election is elected by receiving a majority of all votes cast in the primary election, then the two candidates with the most votes in the primary election will be eligible to run in the general election. Only these two candidates will be eligible to run in the general election, and the one candidate who receives a majority of votes cast in the general election will be declared the winner.

The proposed amendment to Charter section 401.4 also includes a minor change to the number of days within which the nomination papers of candidates for a special primary election must be filed with the Registrar of Voters for examination. This proposal would change the time within which a candidate must file his or her nomination papers with the Registrar of Voters from 39 days to 43 days before the special primary election. This amendment makes this Charter language consistent with State law with respect to the number of days within which nomination papers must be filed with the Registrar of Voters for examination.

A "YES" vote is a vote in favor of all the "write-in" candidate proposed amendments contained in Proposition B.

A "NO" vote is a vote against all the "write-in" candidate proposed amendments contained in Proposition B.
