Should Sections 502b(3) and 502b(4) of the County Charter be amended to limit the unclassified status of persons employed for professional, scientific, technical, expert services or associated services on a temporary basis for a specific project to three consecutive years and to delete part time physicians from unclassified service?

Impartial Analysis
The San Mateo County Charter provides for a limited number of employment positions to be in the unclassified service and thus exempt from Civil Service. Sections 502b(3) and 502b(4) of the San Mateo County Charter presently provide the persons employed to render professional, scientific, expert services, or associated services on a temporalry basis for a specific project and part-time physicians and resident physicians employed in clinics, institutions, and hospitals are in the unclassified service.

This measure would amend Sections 502b(3) and 502b(4) to limit the unclassified status of persons employed for professional, scientific, technical, expert services, or associated services on a temporary basis for a specific project to three consecutive years and to delete part-time physicians from the unclassified service.

Arguments For Measure D Arguments Against Measure D
Currently, persons who have been employed to provide temporary professional and technical services for a specific project are part of the "unclassified service." They are therefore exempt from the civil service rules and processes. The measure provides that if a temporary unclassified employee has been employed in that capacity for three consecutive years, the position shall become part of the classified service. The classified service is an orderly system for addressing the employment of the vast majority of county employees, and it is appropriate for employees whose status has switched from temporary to permanent should be part of this system. If a person has been serving as a temporary employee for three consecutive years, their position should not be exempted from classification on the basis of temporariness. In addition, the measure would delete part time physicians from the unclassified service, as there is no reason to exclude these employees from the county's classified employment system.

Shall Sections 502b(3) and 502b(4) of the County Charter be amended to read as follows:

Section 502. Classified and Unclassified Services b. The unclassified service consists of:

(1) ...
(2) ...
(3) Persons employed to render professional, scientific, technical, expert services or associated services on a temporary basis for a specific project. If any person is so employed for three consecutive years of unclassified service, the position occupied by the person shall become part of the classified service.
(4) Resident physicians employed in clinics, institutions, and hospitals.
