Issue: Dissolving the Criminal Division of the City Attorney's Office.

By Michael J. "Mike" Aguirre

Candidate for City Attorney; City of San Diego

This information is provided by the candidate
Mike Aguirre does not intend to dissolve the Criminal Division of the City Attorney's Office.
All City Attorney candidates have been questioned at length as to whether they plan to transfer misdemeanors to the District Attorney's office. I oppose any such transfer and would like to reiterate my reasons for this opposition.

1. The City Attorney's office needs the authority to handle cases both civilly and criminally. Flexibility is required as, in a single case, either or both remedies may be necessary.

2. The City Attorney's office needs a criminal division in order to accept cases from or transfer cases to the District Attornery. I have been in contact with the DA's office and we plan to collaborate closely on a variety of cases so that, together, we can make the best possible decision as to the disposition of these cases.

3. The City Attorney's office needs to be fiscally responsible. It cannot expect to transfer its misdemeanors to the DA's office without reimbursing the DA for the costs incurred in handling them. This, the city cannot afford.
