Shall the Rural Lands Initiative, which requires newly subdivided parcels on approximately 694,000 acres of rural land in northern and eastern San Diego County to be a minimum of 40, 80, or 160 acres, be approved?

Summary Prepared by County Counsel:
This measure would state its purpose to protect rural lands in the northern and eastern portions of the County of San Diego from development and to limit resulting traffic, water pollution and air pollution. It would require voter approval before these lands may be developed for urban uses. It readopts the "Overall Goal" of the General Plan's Regional Land Use Element, prohibiting any further amendments to this Goal or the minimum parcel sizes set forth in the overlay described below until December 21, 2023, except by vote of the people.

This measure would establish a Clean Water and Forest ("CWF") overlay that would require minimum parcel sizes for new parcels. The following shows the minimum parcel sizes that would be required by this measure in terms of one (1) parcel per a specified number of acres (in other words, the property owner would generally be limited to building one residence on the number of acres indicated with a few exceptions):

Within Estate Development Area
- 1 parcel per 40 acres

Within Rural Development Area
- 1 parcel per 80 acres

Within Environmentally Constrained Areas Inside the County Water Authority Boundary
- 1 parcel per 40 acres

Within Environmentally Constrained Areas Outside the County Water Authority Boundary
- 1 parcel per 160 acres

The overlay would apply only to certain agricultural and sensitive resource lands within these areas. Until December 31, 2023, this measure could not be changed without approval of a majority of County voters except:

The Board of Supervisors ("Board") may add lands to the CWF overlay, may increase the number of acres for each of the specified parcel sizes or make amendments to reorganize the text.

The Board may remove lands from the CWF if failure to do so would result in an unconstitutional taking requiring compensation.

The Board may remove lands from the CWF to comply with State law governing the provision of housing where there are no alternative lands outside the CWF overlay that could be used.

The Board may remove lands where it finds by 4/5 vote that: (i) it would not create any unmitigated, adverse, environmental impacts to specified resources; (ii) it would not adversely affect the stability of land use patterns in the area; and (iii) any new parcel created would have access to an existing publicly maintained road without the need for significant grading.

This measure directs the County to amend as necessary all other land use regulations as soon as possible to ensure consistency with this initiative. It makes conforming amendments to other portions of the General Plan.
