Litigation and Trial Experience: Mr. Burrow has extensive litigation and trial experience in Federal and State courts emphasizing the defense and prosecution of (a) personal injury/tort actions, (b) housing and employment discrimination, (c) professional malpractice, (d) insurance bad faith cases involving breach of fiduciary obligations and fraud, (e) construction defects, (f) breach of contracts/real property litigation, (g) agent and broker duties and responsibilities, (h) mechanics' liens and surety bonds, (i) paternity, (j) defamation and slander, (k) partnership dissolution, and (m) malicious prosecution, resulting in more than twenty jury trials to a conclusion and many bench trials.

Appellate Experience: Mr. Burrow has been involved in several matters that reached the appellate courts. Besides an active writ practice, Mr. Burrow has experience in both Federal and State appeals involving issues concerning housing discrimination, the application of the peculiar risk doctrine in construction accidents and the duty of good faith and fair dealing in contracts.

Alternative Dispute Resolution: Mr. Burrow is regularly requested to act as a judge pro tem by the Santa Clara Superior Court, and as a judicial arbitrator. In addition, Mr. Burrow has been retained to act as a mediator in various types of litigation involving issues of professional malpractice, breaches of fiduciary duties, and personal injuries, and he has acted as a small claims judge.

Veles v. Lindow, 1998, U.S. District Court, San Jose, California Clients: Mary and Carl Lindow, Defendants Principal Issue: Whether or not a landlord can require its tenants to communicate In the English language as a condition of tenancy. Result: Verdict for Defendants, appeal to the 9th Circuit decided in favor of Defendants.

Heredia, et al., v. Farmers Insurance Exchange, 1995, Santa Clara Superior Court. Client: Farmers Insurance Exchange, Defendant Principal Issue: Third party insurance bad faith including breaches of fiduciary duties. Result: Judgement for Defendant after several appeals to the Courts of Appeal.

Hannon v. Chater, 1997 U.S. District Court, San Jose, California Client: T. Patrick Hannon, ESQ., Plaintiff. Principal Issue: Whether or not the Clinton Administration through the Social Security Administration discriminated against Plaintiff based on gender in the selection process of an administrative judicial position. Result: Plaintiff established prevailing party status by way of partial summary judgment before trial in which the court determined that the Plaintiff had been discriminated against. The case then went to trial on the issue of whether or not the candidate selected in Plaintiff's place was more qualified. The jury returned a verdict in favor of Defendant, but Plaintiff was awarded injunctive relief and attorney's fees and is now a sitting Administrative Law Judge with the Social Security Administration.

Vake v. Grandma's Kitchen, 1994, Monterey County Superior Court. Client: Grandma's Kitchen, Defendant Principal Issue: Major personal injury case involving the ingestion of highly toxic restaurant chemicals by minor plaintiff. Result: Verdict for Defendant.

Poulos v. Bendiola, et al., 2000, Santa Clara Superior Court. Client: Nicki Poulos, Plaintiff Principal Issue: Major personal injury involving fracture of Calcaneus. Issues litigated involved nature and extent of injury, course and scope of employment, and the going and coming rule. Result: Verdict for Plaintiff, $380,000.00

McEwan v. Realmonte, 1994, Santa Clara, Superior Court. Client: Brian Realmonte, Defendant Principal Issue: Personal injury, superceding, intervening causation. Result: Verdict for Defendant

Hawkinson v. Dang, 1993, Santa Clara Superior Court. Client: Willy Dang, Defendant Principal Issue: Personal injury, auto vs. bicycle, involving alleged head injury. Result: Verdict for Defendant

Cullan v. Barreras, 2000, Santa Clara Superior Court. Client: Nathan Barreras, Defendant Principal Issue: Personal injury/auto, involving the imminent peril defense and the seat belt defense. Result: Verdict for Defendant.

MILITARY EXPERIENCE

UNITED STATES ARMY - Mr. Burrow received a commission as an Infantry Officer in 1971 and was on active duty from 1971 to 1975 holding the ranks of 2nd Lieutenant, 1st Lieutenant and Captain. Mr. Burrow served as a Platoon Leader, Company Commander and Staff Officer with the 9th Infantry Division and the 1st Armored Division in U.S. Army-Europe. During his activity duty Mr. Burrow received the Army Commendation Medal for exemplary service. Mr. Burrow also served in the U.S. Army Reserves as a Training Company Commander with the 91st Infantry Division.

COMMUNITY ACTIVITIES

YOUTH ATHLETICS: Mr. Burrow has coached both Little League Baseball, and Pop Warner Football. From 1994 to 1999, Mr. Burrow was active in the Los Gatos Pop Warner Football League where he was coach, head coach and league president.

MOCK TRIAL: Mr. Burrow was the Mock Trial coach for the Gunderson High School Mock Trial Team from 1994 to 1998.

PERSONAL INFORMATION

Mr. Burrow was born in Phoenix, Arizona on July 9, 1949 and has resided in San Jose, California since 1975. He is married to Vada Burrow and has three active sons. He enjoys hunting, fly fishing, gun sports and motorcycling.
