Death Penalty

By Gary L. Lacy

Candidate for District Attorney; County of El Dorado

This information is provided by the candidate
I Support the Death Penalty in cases where it is warranted
California voters have determined that the death penalty is the appropriate punishment for certain types of murders. These murders for which the death penalty has been deemed to be appropriate are listed in the California Penal Code as "special circumstance" murders. These special circumstances include, but are not limited to a murder committed for financial gain, multiple murders by the same individual, murder of a person while lying in wait for that person, murder committed using an explosive device, the murder of a police officer performing his or her duties, and the murder of an individual because of his or her race, color, religion or nationality.

I support the death penalty and will seek the death penalty in any case in which it is legally authorized and appropriate in the interest of justice. The determination as to whether to seek the death penalty is a very serious matter and must be made only after very careful and thorough deliberation. It should be based upon an assessment of the circumstances under which the murder was committed, an evaluation of the background of the individual who committed the murder and any other relevant aggravating or mitigating information.
