Shall Ordinance No. 99-47 of the Board of Supervisors of Contra Costa County be approved so as to authorize a one-time special tax of no more than $75 per residential property to fund the development and consideration of a general plan amendment and zoning ordinance regulations to establish in the Diablo Community Services District area a Floor Area Ratios proportionality between houses and their lot sizes?

A "no" vote on the special tax measure is a vote against authorizing the special tax.

Impartial Analysis from County Counsel
The County Board of Supervisors adopted a resolution proposing a special tax upon residential property within the territory of the Diablo Community Services District. The resolution also seeks the voters' opinions on whether the County Board of Supervisors should amend the general plan and zoning code in substantially the same form previously mailed to residents in the Diablo Community Services District area ("Diablo Area").

The special tax measure provides for a one-time special tax of no more than seventy-five dollars ($75.00) per parcel of residential property during fiscal year 2000-2001 (July 1, 2000 through June 30, 2001). The tax per parcel will depend on the property's use code category (the code number assigned by the County Assessor to classify parcels according to property taxes based on the value of property). The tax will not be determined according to the value of property.

The measure provides that the proceeds of the special tax will be used for funding the development and consideration of a general plan amendment and zoning ordinance regulations for the establishment of proportional Floor Area Ratios between houses and their lot sizes in the Diablo Area. Proceeds from the special tax may be used only for the specific purposes set forth in the ballot measure and according to other constitutional and statutory provisions.
