Private property and the environment

By Eugene L. "Gene" Frazier

Candidate for Member of the State Assembly; District 5

This information is provided by the candidate
As long as they harm no one, people should be free to use and defend their property as they see fit.
I will see that true environmental concerns are addressed, while private property rights are maintained. The State has all but ignored the rights of people to use their land as they best see fit, as long as they do not harm others.

All pollution is a form of trespass, where one property owner transfers a substance they do not want onto your property (land, air or water) without your permission. Any individual or company should be held accountable for pollution on your property. Specifically, I will call for the end of MTBE (oxygenated fuel) experimentation and reform of Smog Check II laws.

Again, the State should not interfere with its citizens' private property and land use concerns that do not harm others, or spend taxes promoting special interests. I will oppose any further subsidies of sports facilities to multi-millionaires using your taxes.

I will fight any attempts by government to curb your Second Amendment rights to protect your family and property from violent crime in the manner you best see fit. Protection of property is as valuable as the use of it.

I will also promote a justice system that recognizes the importance of a fully informed jury. When this country was founded, we had a basic concept that the people have the right not only to judge the guilt or innocence of the accused, but whether the law itself is a just one. This is what the Tenth Amendment to the US Constitution is about. It is vital for us to reclaim that right.
