If Measure I is approved to allow the Rosamond Community Services District to exercise the powers granted to it under the Community Services District Law for the purpose of abating graffiti, shall Ordinance No. 99-1 of the Rosamond Community Services District be adopted and approved to establish and authorize the levying of a special tax in an amount up to $2.50 per parcel per fiscal year to finance graffiti abatement?
Impartial Analysis from County Counsel
A "yes" vote by at least two-thirds (2/3rds) of the voters voting on this measure will authorize the Rosamond Community Services District ("District") to levy a special tax for the purpose of financing the District's graffiti abatement powers proposed in Measure I. The maximum amount of the special tax to be levied for graffiti abatement purposes is $2.50 per year per parcel of real property located within the District but may be less as determined by the District. The special tax rates shall automatically increase each year in accordance with the Consumer Price Index ("CPI") applicable to the District, but in no case may the CPI exceed two percent (2%) of the special tax levied in the previous fiscal year.

The District may continue to levy this annual special tax while the District has the authority to exercise graffiti abatement powers. Other than the automatic increase tied to the CPI and capped at 2%, the special tax may not be increased by the District without first obtaining voter approval. The amount levied annually per parcel shall be determined based on the amount necessary to pay the costs of graffiti abatement measures and to pay for the cost of the collection of the tax by the County of Kern. The proceeds of the special tax may not be used for any other purposes.

If this measure is not approved by at least two-thirds (2/3rds) of the voters voting on the measure, the District will not be authorized to levy and collect the special tax to finance graffiti abatement powers. Also, Measure I must be approved by a majority vote in order for the District to have the authority to exercise its powers for the purpose of abating graffiti, which power will be financed by the proceeds of this special tax.

Arguments For Measure J
In order for Rosamond Community Services District (RCSD) to operate a Graffiti Abatement program a special tax of up to Two Dollars and Fifty Cents ($2.50) PER YEAR, PER PARCEL must be approved.

Passing Measure J would give the needed funding to start and maintain a Graffiti Abatement Program. These monies would be used for materials, labor and a telephone "Hot Line".

Community volunteers cannot be expected to be available each and every day. Although volunteers have been battling against graffiti they cannot continue indefinitely.

Graffiti Abatement needs to be a community wide program by an agency that has ongoing responsibility with accountability to the people within its boundaries.

With Rosamond Community Services District having the graffiti abatement power it would be able to: (1) Operate a specifically designated telephone "hot line" for the purpose of receiving reports of application of graffiti on public or private property; (2) remove or contract for the removal of graffiti from any public or private property within its boundaries; and (3) undertake other actions to abate graffiti as a nuisance.

The special tax would be a small cost for a community to show its Price and to say NO TO GRAFFITI!

Recommends approval of Measure J.
