Summary Prepared by the City Attorney:
This ballot measure is before the voters as a result of a referendum petition. The referendum is the right of the citizens to approve or reject a legislative act. The challenged legislative act is Ordinance No. 1706. Ordinance No. 1706 approved a "vested" development agreement [Agreement] between the City of Santa Clara [City] and Sun Microsystems, Inc. [Sun] for a proposed Sun development project on State-owned property known as the Agnews Developmental Center - West Campus [Agnews Site]. The proposed development is on 82.5 acres (of the Agnews Site's approximately 331 total acres) and would consist of the construction of approximately one million square feet of office space for a research and development campus [Sun Project].

Meaning of Voting Yes/No
A YES vote of this measure means:
A majority of Yes votes on Measure D has the effect of approving Ordinance No. 1706 and, hence, the Sun Agreement.

A NO vote of this measure means:
A majority of No votes on Measure D repeals Ordinance No. 1706 and annuls the Sun Agreement. If repealed, the City Council cannot again enact the Ordinance for a year from the date of the election.
